Mangino I - Is Treating Pain a Crime?
Dr. William Mangino remains in custody. His daughter has agreed to be a medium for communication between Dr Mangino and his family, friends, and supporters, and she and I have been in contact this week.
We have an address for anyone interested in writing to Dr. Mangino in jail. I know William spent a lot of time Commenting on internet-published articles and forums, and I know he spent a lot of time reviewing the medical and legal literature which made his online communications usually well worth reading. I hope some of the many people he has shared with will read this, and will write him and send him interesting stuff to read. Snail-mail to:
- Dr. William Mangino
C/O Lawrence County Jail
111 South Milton Street
New Castle, PA 16101
He is destitute, and even the approximately $3500 needed for him to be released pending sentencing is not do-able on short notice. He has every intention of filing an appeal. Assuming for a moment that reasonable bail will be set at Sentencing on 2007-08-14, at 11AM, in Newcastle, PA., it is especially important that Dr. Mangino be able to raise it, because due to his inability to pay for extensive legal and defense expert resources, he needs to be free in order to assist his pro-bono counsel in preparing that appeal.
A Mangino Bail/Defense fund has been set up, and I hope everyone who reads this will please consider helping this good man who has been unfairly impoverished and imprisoned. As I detailed in a previous post, Mangino I - is Treating Pain a Crime?, I reviewed Dr. Mangino’s medical records in preparation of defense expert witness testimony, and I agree with defense expert Dr. Tennant that Mangino’s practice met or exceeded the standard of care and state regulations. His care was entirely reasonable, and there is absolutely no doubt in my mind that he functioned as a physician and acted in the best interests of his patients at all times, and that this was clearly his intent.
Contributions to his Bail/Defense fund should be made out to and sent to William’s personal friend and co-counsel to defense attorney Tom Leslie, Richard Michaelson as follows:
- Richard F. Michaelson, PC, Attorney at Law
Contribution to: the William Mangino Defense Fund

Regarding the defense fund and appeal, lawyer and personal Mangino friend, counselor Michaelson, writes:
Lawrence County, PA, local Trial counsel Tom Leslie and I have been working without pay since the beginning of this investigation.
In addition, expert witness attorney Mary Baluss, Esq (Wash DC) and expert witness Forest Tennant, MD, PhD (California) have both provided their services for free. Mary spent almost a full week at trial, during the presentation of the Governments case. Dr Tennant flew in from California for two days, to provide his fantastic testimony. Many other physicians and advocacy organizations including consultants from the Pain Relief Network offered their services, and we thank all of you.
Please do not give up on this cause. The fight is just in another phase, and if there is still justice in Pennsylvania, this phase will be successful.
Dr. Mangino deserves a fighting chance. He needs our help to get that.
In my next post on the Mangio case, I want to consider in more depth issues raised by the defense’s “Omnibus Motion,” entitled, Motion For a Directed Verdict of Not Guilty Or In the Alternative, Request For Additional Jury Instructions (full text PDF), especially the section of that document that addresses the Jury Instructions given at trial. (Some aspects of the Omnibus Motion were discussed in a previous blog entry here: Mangino Verdict II - Conviction).
