‘A Boundless Field of Power’ - PRN Amicus for Dr. McIver
‘A Boundless Field of Power’ - PRN Amicus Brief for Dr. McIver (full text PDF); Reynolds,S.; Fisher,F.; and, DeLuca,A.; Pain Relief Network; May 2007.
Excerpt:
“To take a single step beyond the boundaries thus specifically drawn around the powers of Congress, is to take possession of a boundless field of power, no longer susceptible of any definition.”
-Thomas Jefferson: National Bank Opinion, 1791.
We assert that Dr. McIver’s conviction is a product of the U.S. Department of Justice’s belief that the Executive branch possesses the authority to define “legitimate medicine”, to promulgate “standards” for medical practice, and to criminally prosecute physicians for violating those “standards”.
Thomas Jefferson warned of the dangers inherent in failing to abide by a restrictive reading of the 10th Amendment…
A Duty To Abandon
The promulgation of “aberrant” behaviors standards by the leadership of the academic pain field has produced a situation which can be accurately characterized as a duty on the part of pain treating physicians to abandon their patients.
As each physician drug-trafficking trial hits the news, these criteria are more vigorously employed by physicians [and state Medical Boards], and thousands more patients are abandoned to the ravages of their disease.
